Definitions

 

Throughout the site, the terms “we”, “us” and “our” refer to Etheridge Trading Ltd. Customers are referred to as “you” or “your”.

This website is operated by Etheridge Trading Ltd.  By visiting our site and/or purchasing something from us, you agree to be bound by the following Terms and Conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 

Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions.

We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

Our store is hosted by Wix. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

Purchasing

 

When purchasing products on the website you agree to provide current, complete and accurate purchase and account information.

 

You must pay us in full by credit card or direct credit at the time that you submit your order. Orders will be despatched after payment has been received by us.

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

 

Products

 

All products are sold subject to their availability.  We shall not be responsible for our inability to supply products to you where they are not presently available or where our stock of the relevant product(s) has been exhausted.

 

 

Pricing

 

All prices on this website are stated in New Zealand Dollars (NZD) and are inclusive of the 15% Goods & Services Tax (GST). Orders will be processed in New Zealand Dollars (NZD) only, we do not accept payments in other currencies.  

 

Payment must be made when placing the order.  We accept payment by Paypal, and direct credit.  When using a card you confirm that you are the cardholder or have permission to make payment with the card by the cardholder.

 

Product prices quoted do not include transit costs. Any courier or handling charges in relation to your order will be notified to you at the time you place your order and be added to the price. Purchases made on our website will be delivered only within New Zealand.

 

Prices for our products are subject to change without notice.  We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time.  We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

 

Delivery

 

Goods will be dispatched no later than two business days after payment of your order is received by us and you have received confirmation of your order from us via email or equivalent.  We are not responsible for any failure to deliver or relay in delivery caused by any event outside of our reasonable control.

 

Orders should be received to the majority of New Zealand addresses within 5 working days.  In the event that we fail to deliver any products, you may elect to cancel your order in respect only of the products not delivered unless we have contacted you and you have agreed to delivery at a later date. 

 

Where we fail to deliver or relay delivery of your order or part of your order or where any loss is incurred by you in relation to such delivery and is within our control, our liability shall be restricted to payment of the cost of replacing the order or part of the order, as we may determine (in our sole discretion). 

 

Advice regarding order shortages or damage in transit must be given to our Customer Services team no later than three days after receipt of products. Please contact sales@theolivelady.co.nz .

 

Delivery is complete when the products reach the address you have specified for delivery. We will be responsible for arranging the delivery of products unless you arrange otherwise with us. 

 

Nothing in these terms entitles you to return the products as being surplus to your needs, or for any other reason other than set out herein.

 

We do not deliver to P O Box addresses, we deliver to your physical address.

 

Cancellation, Return and Replacement

 

After we have accepted your order for the products, you may not cancel the order without our consent.  Returns for credit will be given at our discretion. The cost of return is your responsibility.

 

Errors, Inaccuracies and Omissions

 

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

 

Intellectual Property

 

All right, title and interest in all Intellectual Property in all concepts, systems, written, graphic and other material relating Etheridge Trading Ltd’s online shop and its contents owned by, and shall at all times remain the exclusive property of Etheridge Trading Ltd, its licensors and the providers of products accessible through Etheridge Trading Ltd’s online shop, and is protected by New Zealand law. Nothing in these terms and conditions shall constitute any licence of intellectual property rights to the Customer. 

 

Any infringement of our intellectual property rights will be fully enforced under New Zealand law.

 

No Waiver

 

No delay, neglect or forbearance in taking enforcement action in relation to any provision of these terms will be a waiver, or in any way prejudice any right, of that party. 

 

Severability

 

If any part of these terms is held to be invalid, illegal or unenforceable, that part will be severed and the remainder of the terms will remain in full force and have full effect. 

 

Termination

 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our services (or any part thereof).

 

Governing Law

 

The contract between us shall be governed by the laws of the New Zealand and any dispute between us will be resolved exclusively in the courts of New Zealand. English is the only language offered for the conclusion of the contract.
